Who knows the load with the daily traffic jam and delayed trains, will surely get sparkling eyes here, because saving time means saving costs at the same time.

Another advantage is the lower cost, also in relation to the rent for a classic office outside your own four walls. Of course, this is not the case with a home office. Unless, of course, you look for an additional room for your study when looking for an apartment. But even here the costs are lower than for an external office. All in all, start-ups have the opportunity to save a lot of money by starting their own business from their home office. After all, a table, a chair, a computer or laptop, a printer, pens and paper are usually already available.

But unfortunately it is not as easy as it sounds here to set up a home office and start your own business from home. Because anyone who simply puts a company sign next to the bell without informing the landlord about the commercial use can get into trouble.

Who is suitable for working in the home office?

In order to find out whether you can start your independence from home with peace of mind, you should answer the following questions honestly.

As suitable for the home office, one would probably call someone who can answer the preceding questions predominantly with “yes”. The same applies if you offer your employees the home office. Here, too, you should be convinced that your employees would answer most questions in the affirmative.

Working as a freelancer in the home office

If you plan to work in your home office, you should first check what the lease says about commercial use. In particular, if the lease excludes such use, the next step is to contact the landlord. This is because the landlord must always know when founders are planning to use the rented apartment in a semi-commercial manner.

Altogether the chances stand well for a permission of the landlord for the teilgewerblichen use of the rented dwelling, if with the mechanism of the domestic work room no impairments accompany. This refers to noise, heavy customer traffic or parking problems.

But: Just because your landlord has allowed you to set up a home office and use the rented apartment for partial commercial purposes does not mean that you may affix a company sign of any size next to your bell. Here, too, the landlord has a word to say and can veto the installation of an oversized company sign, which is obviously used for advertising purposes.

In addition, the landlord may be entitled to a trade surcharge if founders request semi-commercial use. Here, too, it is advisable to study the lease carefully. If you are not sure whether you are allowed to use your apartment for semi-commercial purposes and whether a trade surcharge could be due, you should ask a lawyer for advice.

It becomes even more difficult if self-employed people want to hire an employee who will also get a job in the rented apartment in the future. Here the landlord has the right to refuse his permission. If the founder nevertheless expands his home office with a workplace for his employee, he can be dismissed.
